Can I challenge a personal guarantee in Doncaster? +
Yes. Personal guarantees are not automatically enforceable. We can review the terms of your guarantee and advise whether there are grounds to challenge it — for example, if the creditor failed to follow proper procedures or failed to mitigate their losses.
What does a legal adviser cost in South Yorkshire? +
Our initial consultation is £50 fixed fee. Document review starts from £75 fixed fee. Defence preparation is from £150. All fees are agreed before any work begins — there are no hourly billing surprises.
Can I set aside a County Court default judgment? +
Under CPR 13.3, you can apply to set aside a default judgment if you were not aware of the proceedings or if you have a real prospect of successfully defending the claim. We can help you prepare this application and supporting witness statement.
What is the creditor's duty to mitigate losses? +
When a lender repossesses and sells goods, they are legally required to take reasonable steps to obtain a fair market price. If they sell at a significant undervalue — for example, at auction for a fraction of market value — you may not be liable for the full claimed shortfall.
Is a legal adviser the same as a solicitor? +
No. A legal adviser is not regulated by the SRA and cannot conduct litigation or appear in court on your behalf. However, we can provide legal advice, review documents, draft correspondence and witness statements, and assist you as a McKenzie Friend in some proceedings.
Do you cover areas outside Doncaster? +
